Massage Establishment Permit

It is the purpose and intent of Chapter 5.32 of the Morgan Hill Municipal Code to provide for the orderly regulation of offices and establishments providing massage therapy services, and to prevent and discourage the misuse of massage therapy as a front for human trafficking, prostitution, and related activities in violation of state law.

This is in the interests of the public health, safety, and welfare, by providing certain minimum building, sanitation, and operation standards for such businesses, and by requiring certain minimum qualifications for the operators and practitioners of such businesses.

A Massage Establishment within the City of Morgan Hill must obtain a Massage Establishment Permit from the Police Department before massage therapy services can be offered in addition to having a City of Morgan Hill Business License.

  • The Massage Establishment Permit Application should be submitted via email to the Police Department's License-Permits Division for review and approval.
  • Additional permits, licenses, certifications, and paperwork as stated in MHMC Chapter 5.32 should be submitted via email to the Police Department's License-Permits Division.
  • The Massage Establishment Permit Fee is to be paid in full.
  • Massage Establishment Owners will be notified of their permit approval or denial.

  • Massage Establishment Permits are renewed annually.
  • Request an amended permit whenever the information contained in the original permit application changes, including addition or removal of employees by using the Addendum Form.
  • Massage Establishment Owners are responsible for:
    • The conduct of all massage establishment employees, agents, and other representatives when such persons are on the premises of the massage establishment.
    • The conduct of all massage establishment employees, agents, and other representatives when such persons are providing out-call massage services on behalf of the establishment.
